These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you" or "Customer") and Deezme Mobitec Solutions Electronics Limited ("Company", "we", "us", or "our") governing access to and use of our website, products, and services, including installment-based purchases under the Lipa Polepole program.

By accessing our website or completing a transaction, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use our services.

1. Eligibility and Account Responsibility

  • You must be at least 18 years old to transact with us.
  • You are responsible for ensuring that all information provided is accurate and up to date.
  • You are solely responsible for maintaining the confidentiality of your account and login credentials.
  • We reserve the right to suspend or terminate accounts that provide false information or engage in suspicious activity.

2. Orders and Acceptance

  • All orders are subject to acceptance and availability.
  • We reserve the right to refuse, cancel, or limit any order at our sole discretion.
  • An order is only deemed accepted once full or agreed payment has been successfully verified.
  • We may cancel orders in cases of pricing errors, suspected fraud, or stock unavailability.

3. Pricing and Errors

  • All prices are listed in Kenyan Shillings unless otherwise stated.
  • We reserve the right to correct pricing or product description errors at any time without prior notice.
  • Where an error affects your order, we may cancel the order and issue a refund where applicable.

4. Payment Terms

  • Payments are primarily processed via M-Pesa. Card payments may be processed through third-party providers.
  • You are responsible for ensuring that payment details are correct before confirming a transaction.
  • Transactions are considered complete only after confirmation is received from our payment systems.
  • We are not responsible for delays or failures caused by third-party payment providers.
  • In the event of fraudulent or disputed transactions, we reserve the right to suspend order processing pending investigation.

5. Lipa Polepole (Installment Plan)

  • Eligibility for the installment plan is subject to internal assessment and approval.
  • Ownership of the product remains with the Company until full payment is received.
  • Failure to meet agreed payment timelines constitutes default.
  • In case of default, we reserve the right to suspend services, block access, or recover the product without prior notice.
  • Any amounts paid prior to default may be treated as usage or administrative fees and may not be refundable.

6. Delivery and Risk

  • Delivery timelines are estimates and are not guaranteed.
  • Risk of loss or damage passes to you upon delivery of the product.
  • We are not liable for delays caused by third-party couriers or events beyond our control.

7. Returns, Refunds, and Exchanges

  • Returns must be reported within 24 hours of delivery unless otherwise stated.
  • Products must be unused, in original condition, and in original packaging.
  • Refunds are issued only after inspection and approval.
  • We reserve the right to reject returns that do not meet our conditions.

8. Warranty Disclaimer

Unless expressly stated, all products are provided "as is" without warranties of any kind, either express or implied. Any manufacturer warranties, where applicable, are handled directly with the manufacturer.

9. Prohibited Use

  • Use of the website for fraudulent or unlawful purposes is strictly prohibited.
  • Attempting to interfere with the website’s functionality or security is prohibited.
  • We reserve the right to block access for violations.

10. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business arising from the use of our services or products.

11. Indemnity

You agree to indemnify and hold harmless the Company, its directors, and employees from any claims, damages, or losses arising from your misuse of the website or breach of these Terms.

12. Force Majeure

We shall not be held liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, network failures, strikes, or government actions.

13. Termination

We reserve the right to suspend or terminate access to our services immediately where a breach of these Terms is identified.

14. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.

15. Amendments

We reserve the right to modify these Terms at any time. Continued use of the website constitutes acceptance of the updated Terms.
